IMPORTANT: MediTests is not a healthcare provider and does not provide medical services, clinical diagnoses, or treatment. Our platform facilitates access to pathology testing only. Nothing on our platform constitutes medical advice. Always consult a qualified healthcare professional regarding your health.

1. About MediTests and These Terms

MediTests Pty Ltd ACN 686 814 951 (MediTests, we, us, our) owns and operates the online platform located at www.meditests.com.au (Platform). These Terms and Conditions (Terms) govern your access to and use of the Platform and your purchase of any services through it.

By using the Platform or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree to these Terms, you must stop using the Platform immediately.

We may update these Terms at any time by publishing a revised version on the Platform. Continued use of the Platform after any update constitutes acceptance of the revised Terms. We recommend checking this page periodically.

These Terms are governed by the laws of Western Australia, Australia.

2. Definitions

In these Terms, the following words have the meanings set out below:

Collection Centre means an independent, NATA-accredited pathology collection facility listed on the Platform at which you may attend to have your sample collected for the Tests you have ordered.

Fee means the price payable for a Test as displayed on the Platform at the time of your order.

Laboratory / Laboratory Partner means an independent, NATA-accredited pathology laboratory that processes samples and generates Test results on behalf of Collection Centres.

Order means a confirmed request submitted through the Platform by you to purchase one or more Tests.

Platform means the MediTests website at www.meditests.com.au and any related pages, applications, or digital interfaces operated by us.

Referral means the pathology referral form (also called a pathology request form) prepared and issued by MediTests to you following a confirmed Order, authorising you to attend a Collection Centre for the specified Tests.

Test means a pathology test or panel of tests available for purchase through the Platform.

Test Kit means an at-home collection kit, where applicable, sent to you by post to collect a biological sample for testing.

Test Results means the results of a Test generated by the relevant Laboratory and provided to you by MediTests.

You / Your means the individual who accesses or uses the Platform or purchases any service through it.

3. Nature of Our Service and Important Limitations

3.1 What We Do

MediTests is a referral facilitation platform. Our service is limited to:

  • Providing you with information about available Tests and their associated Collection Centres;
  • Accepting payment and processing your Order;
  • Preparing and issuing a Referral authorising you to attend a Collection Centre;
  • Receiving basic Test Results from the Laboratory and making them available to you; and
  • Indicating whether individual results appear within or outside standard reference ranges for informational purposes only.

3.2 What We Do Not Do

MediTests does not provide healthcare services, medical advice, clinical diagnoses, treatment recommendations, or prescriptions. We are not a healthcare provider, medical practice, or registered health service.

Specifically, MediTests does not:

  • Diagnose, treat, cure, or prevent any disease or medical condition;
  • Provide a doctor-patient relationship or any equivalent professional relationship;
  • Interpret your Test Results in a clinical or individualised context;
  • Provide advice tailored to your specific medical history, circumstances, or risk profile; or
  • Supervise, control, or take responsibility for the services provided by Collection Centres or Laboratories.

3.3 Informational Nature of Results

Any indication provided by MediTests that a Test Result is ‘normal’ or ‘abnormal’ is based solely on standard population reference ranges. It is not a medical opinion, clinical assessment, or advice specific to your health situation.

You must not make any health decision — including decisions about medication, treatment, diet, lifestyle, or further investigation — based solely on Test Results provided through our Platform, without first consulting a qualified healthcare professional.

If your results are significantly outside normal ranges or you have any concerns about your results, you should seek medical attention promptly.

3.4 Not Suitable for Urgent or Complex Health Needs

Our services are not appropriate for emergency medical situations, acute health conditions, or circumstances requiring immediate medical attention. If you are experiencing a medical emergency, call 000.

If you have a chronic or complex health condition, are taking regular medications, are pregnant or breastfeeding, or have any concern that a particular Test may not be appropriate for you, you should consult your doctor before placing an Order.

4. Eligibility and Customer Obligations

4.1 Age Requirement

You must be at least 18 years of age to use the Platform and purchase Tests. By using the Platform, you represent and warrant that you are 18 years of age or older. MediTests reserves the right to decline orders or cancel accounts where it suspects this requirement has not been met.

4.2 Australian Residents Only

Our services are intended for individuals physically located in Australia at the time of ordering and sample collection. Tests must be completed at authorised Collection Centres within Australia.

4.3 Accuracy of Information

You represent and warrant that all information you provide to MediTests — including your name, date of birth, sex, contact details, and any other information required to process your Order — is true, accurate, current, and complete. Providing false or inaccurate information may result in incorrect Referrals, delayed or invalid Test Results, and may void your eligibility for any remedy.

MediTests is not liable for any consequences arising from incorrect information provided by you, including where results are delivered to an incorrect contact address, or where a Referral contains errors as a result of your input.

4.4 Pre-Test Preparation

Certain Tests require preparation steps such as fasting, avoiding specific substances (e.g. alcohol, caffeine, tobacco), or collecting your sample at a specific time of day. Instructions for each Test are provided on the Platform and may also be included with your Referral.

It is your sole responsibility to read and follow all pre-test preparation instructions. MediTests accepts no responsibility for inaccurate, invalid, or inconclusive results arising from your failure to comply with preparation requirements. In such circumstances, no refund will be issued and a new Order will be required.

4.5 Prohibited Use

You must not use the Platform for any unlawful purpose, or in any manner inconsistent with these Terms. Without limiting the foregoing, you must not:

(a) Use the Platform to access services on behalf of another person without their knowledge and consent; (b) Attempt to access, tamper with, or disrupt the Platform, its systems, or any related infrastructure; (c) Use automated scripts, bots, or similar tools to interact with the Platform; (d) Engage in abusive, threatening, discriminatory, or vexatious conduct toward MediTests staff; (e) Reproduce, resell, or commercially exploit any content, Referral, or other material from the Platform; or (f) Use the Platform if you are a competitor seeking to extract business information or intellectual property.

5. Orders, Fees, and Payment

5.1 Placing an Order

Orders are placed through the Platform by selecting your desired Test(s), providing required personal details, and completing payment. An Order is confirmed when you receive a confirmation email from us.

We reserve the right to decline, cancel, or limit any Order at our discretion, including where we reasonably suspect fraud, misuse, or a breach of these Terms.

5.2 Fees and Pricing

Fees are displayed on the Platform at the time of ordering and include applicable GST. We reserve the right to change pricing at any time. The Fee applicable to your Order is the price displayed at the time your Order is confirmed.

Fees do not include any charges that may be imposed by a Collection Centre if you attend an unauthorised facility (see clause 6.3).

5.3 Payment

Payment is processed at the time of ordering through our third-party payment provider. By providing payment details, you authorise us to charge the full Fee for your Order. You warrant that you are authorised to use the payment method provided.

MediTests is not responsible for fees, charges, or penalties imposed by your financial institution in connection with your payment.

5.4 Additional Fees

We reserve the right to charge additional fees in the following circumstances:

  • Unauthorised Collection Centre: If you attend a collection centre not listed on the Platform or specified on your Referral, you may be charged any additional costs incurred by MediTests as a result.
  • Referral Misuse: If you use a Referral more than once, use it beyond its validity period, or use it to request tests not included in your Order, additional fees may apply.
  • Multiple Visits for a Single Form: Each Referral is intended for a single visit to a Collection Centre. Tests on a single Referral cannot be split across multiple visits unless expressly permitted.

6. Referrals, Collection Centres, and Test Kits

6.1 Issuance of Referrals

Upon confirming your Order and receipt of payment, MediTests will prepare and email your Referral to the email address you provided. The Referral authorises you to attend an approved Collection Centre to have your sample collected.

Your Referral is typically valid for 6 months from the date of issue, unless otherwise stated on the Referral itself. Expired Referrals cannot be used and will not be reissued or refunded.

6.2 Your Responsibilities at the Collection Centre

You must:

  • Attend a Collection Centre listed on the Platform and specified on your Referral;
  • Bring your Referral (printed or digital, as accepted by the Collection Centre);
  • Provide accurate personal identification if requested by the Collection Centre; and
  • Comply with any preparation instructions relevant to your Test(s).

6.3 Authorised Collection Centres Only

Your Referral is only valid at Collection Centres listed on the MediTests platform. Using an unauthorised facility may result in additional fees, test failures, or result delivery issues — none of which are the responsibility of MediTests.

MediTests has established specific processing arrangements with its partner Collection Centres and Laboratories. If you attend an unauthorised collection centre:

  • MediTests will not be responsible for missed tests, processing errors, or delays;
  • No refund will be issued; and
  • Any fees charged by the unauthorised centre will be your sole responsibility.

6.4 Recollection

If a Laboratory or Collection Centre requires you to return for a recollection (for example, due to an insufficient, haemolysed, or otherwise compromised sample), this forms part of the standard pathology process and does not entitle you to a refund. Recollection may be required for reasons including — but not limited to — insufficient sample volume, sample degradation, or collection centre handling.

Where a recollection is required due to a confirmed error by the Collection Centre or Laboratory, please contact us and we will assist in facilitating communication with the relevant party. MediTests may, at its sole discretion, offer partial credit or other remedial action, but is not obligated to do so.

6.5 Test Kits

Where a Test Kit is ordered, it will be dispatched to the address provided at the time of Order. You are responsible for:

  • Providing a correct and current delivery address;
  • Following all collection and return instructions included with the Test Kit; and
  • Returning the sample within the timeframe specified.

MediTests is not responsible for delays caused by postal or courier services. If a Test Kit is lost in transit, damaged, or arrives in unsatisfactory condition, please contact us at info@meditests.com.au and we will assess the situation on a case-by-case basis.

7. Test Results

7.1 Delivery of Results

Test Results are typically delivered to your nominated email address within 24–48 hours of your sample being processed by the Laboratory, though some specialised tests may take longer. MediTests does not guarantee specific turnaround times as results are dependent on the independent Laboratory.

MediTests is not liable for delays in the delivery of Test Results, whether caused by Laboratory processing times, postal delays (for Test Kits), or technical issues outside our control.

7.2 Nature of Results

Results will include an indication of whether each result falls within or outside standard reference ranges. This is provided for informational purposes only and does not constitute a medical diagnosis, clinical assessment, or personalised health advice.

Reference ranges are based on general population data and may not be appropriate for your individual circumstances, medical history, or current health status.

7.3 Grossly Abnormal Results

Where Test Results are significantly outside normal reference ranges, MediTests will take reasonable steps to notify you and recommend that you seek medical attention. This does not constitute medical advice or clinical management. You remain solely responsible for seeking appropriate professional care.

7.4 Notifiable Diseases

Certain pathology results may relate to conditions that are notifiable under Australian state and territory public health legislation (including, by way of example, certain sexually transmitted infections). In such cases, the Laboratory is legally required to report the relevant result to the applicable public health authority. This reporting obligation is imposed by law and does not require your consent. You may be contacted directly by a public health unit as a result.

7.5 Accuracy and Responsibility

Test Results are generated by independent, NATA-accredited Laboratories. MediTests does not perform or supervise testing and does not warrant the accuracy, completeness, or fitness for purpose of any Test Result. MediTests’ role is limited to transmitting results as received from the Laboratory.

You acknowledge that all healthcare decisions must be made in consultation with a qualified medical professional who has full knowledge of your medical history and circumstances.

8. Independent Laboratories and Collection Centres

Collection Centres and Laboratories are entirely independent of MediTests. MediTests does not own, operate, employ, or control any Collection Centre or Laboratory, and has no authority over their staff, procedures, quality systems, or performance.

MediTests is not responsible or liable for:

  • Errors, delays, or inaccuracies in testing or result generation by a Laboratory;
  • The conduct, competence, or professionalism of Collection Centre staff;
  • Lost, contaminated, mislabelled, or insufficient samples;
  • Equipment failures or laboratory system outages;
  • Additional charges levied by a Collection Centre; or
  • Any other act, omission, or failure by an independent Collection Centre or Laboratory.

Any complaints relating to Collection Centre or Laboratory services should be directed to the relevant provider. MediTests will provide contact details to assist you and will endeavour to support communication, but cannot compel any action by independent third parties.

9. Refunds and Cancellations

Our full Refund Policy is available at meditests.com.au/refund-policy and forms part of these Terms. The following is a summary of key refund terms.

9.1 Refunds Available

  • Pre-issuance cancellation: If you cancel before your Referral has been issued, you are entitled to a refund less a $10 administrative processing fee.
  • Defective Referral: If your Referral contains an error caused by MediTests, you are entitled to a corrected Referral or a full refund if we cannot rectify the error.
  • ACL Guarantees: Refunds may be available where a service fails to meet a consumer guarantee under the Australian Consumer Law.

9.2 Refunds Not Available

Once a valid Referral has been issued, our core service is fulfilled. Refunds are not available in the following circumstances:

  • Change of mind after Referral issuance;
  • Failure to attend a Collection Centre or use the Referral before it expires;
  • Refusal to return for a recollection after a sample has been collected;
  • Failure to follow pre-test preparation instructions;
  • Dissatisfaction with Test Results;
  • Test failures resulting from your use of an unauthorised Collection Centre; or
  • Orders cancelled outside any applicable cancellation window.

9.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or guarantee you have under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)). To the extent any provision is inconsistent with the ACL, the ACL prevails.

10. Intellectual Property

All content on the Platform — including text, graphics, logos, images, test descriptions, and the Platform’s underlying code and architecture — is owned by or licensed to MediTests and is protected by Australian and international copyright and intellectual property laws.

By using the Platform, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for the purpose of ordering and receiving Tests for your personal, non-commercial use.

You must not, without our prior written consent:

  • Copy, reproduce, republish, distribute, or transmit any part of the Platform or its content;
  • Use any Platform content for commercial purposes;
  • Reverse engineer, decompile, or attempt to extract source code from the Platform;
  • Use our trademarks, branding, or logos without authorisation; or
  • Frame, scrape, or mirror any part of the Platform.

11. Privacy

MediTests collects, uses, and discloses personal and health information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy available at meditests.com.au/privacy-policy.

By using the Platform and ordering Tests, you consent to the collection, use, and disclosure of your personal information (including sensitive health information) for the purposes of:

  • Processing your Order and issuing your Referral;
  • Transmitting your sample information to the relevant Collection Centre and Laboratory;
  • Receiving and delivering your Test Results;
  • Communicating with you about your Order; and
  • Complying with applicable legal obligations, including public health reporting requirements.

Your health information will not be shared with third parties except as necessary to provide our services, as required by law, or as set out in our Privacy Policy. MediTests does not sell personal information.

12. Competitors

If you operate a business that provides services similar to those of MediTests — including self-request pathology facilitation, referral services, or related health testing platforms — you are considered a competitor for the purposes of these Terms.

Competitors are strictly prohibited from accessing the Platform for the purpose of extracting business information, pricing data, test descriptions, workflows, or any other commercial intelligence. Any such access constitutes a breach of these Terms and may give rise to legal action. MediTests reserves all rights to seek compensation, injunctions, and any other available legal remedy.

13. Disclaimers and Limitation of Liability

13.1 General Disclaimer

To the fullest extent permitted by law, the Platform and all content, services, Test Results, and materials provided through it are supplied on an ‘as is’ and ‘as available’ basis, without any warranty, representation, or guarantee of any kind, whether express or implied.

MediTests does not warrant that:

  • The Platform will be available, uninterrupted, error-free, or free from viruses or harmful components;
  • Information on the Platform is accurate, complete, current, or suitable for any particular purpose;
  • Test Results will be accurate, complete, or free from Laboratory error; or
  • Use of our services will achieve any particular health outcome.

13.2 Health and Medical Disclaimer

MediTests expressly disclaims any warranty that its services will diagnose, prevent, treat, or cure any disease or medical condition. Our services are for informational and facilitation purposes only. The consequences of any health decision you make — whether or not informed by Test Results — are your sole responsibility.

13.3 Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law and other applicable legislation, MediTests’ total aggregate liability to you, arising out of or in connection with these Terms or your use of the Platform, shall not exceed the total amount you paid to MediTests for the specific Order giving rise to the claim.

In no event will MediTests be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages;
  • Loss of profit, revenue, data, goodwill, or business opportunity;
  • Personal injury or health outcomes arising from Test Results or your reliance on them;
  • Acts, omissions, or negligence of any independent Collection Centre or Laboratory; or
  • Delays in receipt of Test Results, however caused.

These limitations apply regardless of the legal theory on which any claim is based, including contract, tort, negligence, statute, or equity.

13.4 Exceptions

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, or right under the Australian Consumer Law that cannot lawfully be excluded. Where liability cannot be excluded under the ACL but can be limited, MediTests’ liability is limited to resupplying the relevant service or paying the cost of having the service resupplied, at MediTests’ election.

14. Indemnity

You agree to indemnify, defend, and hold harmless MediTests, its officers, directors, employees, contractors, and agents from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or relating to:

(a) Your use of the Platform or any service provided through it; (b) Any breach of these Terms by you; (c) Your provision of false, inaccurate, or incomplete information; (d) Your failure to follow pre-test preparation instructions; (e) Your use of an unauthorised Collection Centre; (f) Your reliance on Test Results without seeking appropriate professional medical advice; (g) Any harm, injury, or adverse event arising from sample collection at a Collection Centre; or (h) Any violation of applicable law by you in connection with your use of the Platform.

15. Suspension and Termination

MediTests reserves the right to suspend or terminate your access to the Platform, cancel any Order, and void any Referral at any time and without notice if:

  • You breach any provision of these Terms;
  • You engage in fraudulent, abusive, or unlawful conduct;
  • You provide false or materially misleading information;
  • MediTests is required to do so by law or a regulatory authority; or
  • MediTests determines, in its reasonable discretion, that continued provision of services to you is inappropriate.

In the event of termination for cause, no refund will be payable unless required by the ACL.

16. Dispute Resolution

16.1 Contact Us First

If you have a complaint or dispute, please contact us in the first instance at info@meditests.com.au with full details of your complaint, including your Order number, the nature of the issue, and your proposed resolution. We will acknowledge your complaint within 2 business days and aim to resolve it within 7 business days.

16.2 Mediation

If a dispute cannot be resolved through direct negotiation within 28 days of written notice being provided, either party may refer the dispute to mediation. The mediator will be jointly selected by the parties, or if agreement cannot be reached, appointed by the Australian Mediation Association. The costs of mediation will be shared equally unless otherwise agreed.

All mediation proceedings are confidential and are treated as ‘without prejudice’ negotiations.

16.3 Legal Proceedings

If mediation does not resolve the dispute within 60 days of commencement, either party may pursue legal proceedings. Legal proceedings must be brought in the courts of Western Australia.

17. General Provisions

17.1 Governing Law and Jurisdiction

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Western Australia.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions will continue in full force and effect.

17.3 Waiver

A failure or delay by MediTests to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. Any waiver must be in writing to be effective, and applies only to the specific circumstance in respect of which it is given.

17.4 Assignment

You may not assign, transfer, or sub-licence your rights or obligations under these Terms without our prior written consent. MediTests may assign or transfer its rights and obligations under these Terms to any entity at any time, including in connection with a business sale, merger, or restructure, without your consent.

17.5 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and MediTests with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.

17.6 Force Majeure

MediTests will not be liable for any failure or delay in performance of its obligations caused by circumstances beyond its reasonable control, including acts of God, natural disasters, pandemic or public health emergency, government action, power outages, telecommunications failures, cyberattacks, or failures by third-party service providers including Laboratories and Collection Centres. MediTests will notify you of any material service disruption as soon as reasonably practicable.

17.7 No Medical or Professional Relationship

Nothing in these Terms or your use of the Platform creates a doctor-patient relationship, healthcare provider relationship, fiduciary duty, or any other professional relationship between you and MediTests. MediTests is a technology and facilitation platform only.
